Tenancy Agreement
THIS AGREEMENT made at Mumbai this __________ day of April, 1998 BETWEEN (1)………………………….. & ………………………,all residing at …….…………. hereinafter called "The Landlords" (which expression shall mean and include their respective heirs, executors, administrators and assigns) of the One Part AND (1) ……………………. & ………………………., hereinafter referred to as "The Tenants" (which expression shall mean and include their respective heirs, executors, administrators and assigns) of the Second Part AND ……………………………, hereinafter referred to as "The Confirming Party" (which expression shall mean and include her heirs, executors, administrators and assigns) of the Third Part;

WHEREAS the Landlords are the owners and are entitled to flat No. ……, on the …… floor, in "…………………….", situated at ……………………………….., hereinafter "The Said Premises" ;

AND WHEREAS the landlords had given the Said Premises to the Confirming Party since many years on tenancy basis;

AND WHEREAS the Confirming party has agreed to surrender her tenancy rights of the Said Premises in favour of the Landlords, upon the landlords agreeing to compensate her for the same;

AND WHEREAS the Landlords and the confirming party have entered into Agreement for Surrender of Tenancy Rights dated ……….. day of ……………. by which the Landlords have accepted to compensate the Confirming Party for surrender of tenancy rights;

AND WHEREAS the Tenants are in need of accommodation and as such approached the Landlords to allow them to use and occupy the Said Premises for their residence only.

AND WHEREAS the landlords have agreed to give the Said premises on Tenancy basis to the Tenants on and from the …………. day of ………….. upon the terms and conditions hereinafter appearing;


NOW THIS AGREEMENT WITNESSETH AS UNDER :

1. The Landlords have agreed to give and the Tenants have agreed to take the Said Premises on Tenancy Basis.

2. The Tenants has agreed to deposit with the Landlords a sum of Rs. …………./- (Rupees …………………… only) as interest free Security Deposit during the tenure of this agreement, which amount is being paid to the Confirming party, on behalf of the Landlords for surrender of tenancy rights of the Said premises.

3. The Tenants shall pay to the Landlords Rs. ……../- (Rupees ……………… only) per month as Rent for the use of the Said Premises. The Tenants shall also pay Municipal taxes for the Said Premises.

4. This Agreement shall commence from the ………. day of …………….

5. The Tenants hereby agree that the Said Premises shall be used for the purpose of residence only and shall do any alteration or addition of a permanent or structural nature in the Said Premises which the landlords agree but subject to be approved of the B.M.C. However, the Tenants are explicitly permitted to put partitions, fittings and fixtures, add bathrooms, re-tile the floors and install air-conditioners and bring and install its own furniture as and when they desire without any permission from the Landlords. However for construction of the lofts in the Said Premises, the Landlords do not have any Objection for the same, but it shall be constructed only upon getting the approval from the B.M.C.

6. The Tenants shall keep and maintain the interior of the Said Premises in good repair and condition (reasonable wear and tear and loss or damage by fire, flood, earthquake, tempest, riots, civil commotion, violence, of an army or mob, Act of God or other irresistible force or inevitable accident only excepted.)

7. The Tenants shall not do or suffer to be done in or upon the Said Premises anything which is nuisance or annoyance to the other occupants of the Said building.

8. The Landlords undertake not to evict the Tenants from the Said Premises on the ground of personal use of the Said Premises or any reason whatsoever.

9. The Landlords are representing and warranting that they are entitled to give the Said Premises on tenancy basis to the Tenant and to enter into this Agreement.

10. The Tenants shall observe the rules, regulations and bye-laws in so far as and to the extent they are required to be observed by the occupants of the Said Premises.
